  • Malware, viruses, or harmful code
  • Adult content without proper labeling

4.2 Prohibited Activities

You must not:

  • Harvest email addresses through unauthorized means

  • Forge headers or otherwise disguise the origin of emails
  • Attempt to circumvent spam filters or delivery systems

5. Subscriber Consent & Privacy

You are responsible for obtaining proper consent from your subscribers before adding them to your email lists. This includes:

  • Explicit opt-in consent for marketing emails
  • Clear disclosure of what emails they will receive
  • Providing a working unsubscribe mechanism
  • Honoring unsubscribe requests promptly
  • Complying with data protection regulations (GDPR, CCPA, etc.)

6. Intellectual Property

6.1 KiriMel Property

The Service, including all software, designs, text, graphics, and logos, is owned by KiriMel and protected by intellectual property laws.

6.2 Your Content

You retain ownership of the content you create or upload to the Service. By using the Service, you grant us a license to store, process, and transmit your content for the purpose of providing the Service.

7. Payment & Billing

7.1 Fees

Certain features of the Service may require payment. All fees are non-refundable unless otherwise stated.

7.2 Billing

You agree to provide accurate billing information and authorize us to charge your payment method for any fees incurred. We reserve the right to suspend service for non-payment.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may suspend the Service for maintenance, updates, or other reasons without liability.

9. Termination

You may terminate your account at any time through your account settings or by contacting customer support.

9.2 By KiriMel

We reserve the right to suspend or terminate your account for:

  • Violation of these Terms
  • Abuse of the Service
  • Non-payment of fees
  • Sending spam or violating email regulations
  • Any reason at our sole discretion with 30 days notice

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

KIRIMEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless KiriMel from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or send through the Service

13. Data Processing

As a data processor, KiriMel processes email data on your behalf. You remain the data controller and are responsible for ensuring compliance with applicable data protection laws.

You must comply with all applicable email marketing laws, including but not limited to:

  • CAN-SPAM Act (United States)
  • GDPR (European Union)
  • CASL (Canada)
  • Privacy Act (Australia)
  • PECR (United Kingdom)

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where KiriMel is established, without regard to conflict of law provisions.
